Terms of Use

Luxsphera is operated by Dallas Ray Jackson, a sole proprietor in South Carolina, USA (“we”, “us”). Contact: hello@luxsphera.com.

Words we use

• Sphere: a private group inside Luxsphera, like your household, your extended family or a group of friends. Each sphere has its own members, chat (its main chat is called the Hearth), calendar, board and photo albums. Only the people in a sphere can see what's shared in it.
• Manager: the person who looks after a sphere: they invite and approve members and can remove things shared in it. A sphere can have more than one manager.
• Ray: a short video shared with the spheres you choose. It disappears after 7 days unless someone you shared it with saves it.
• Lumens: Luxsphera's credits for paid apps and games. One Lumen is worth 10 cents.
• Guardian: a parent or guardian who created or looks after a kid's account.

1. Using Luxsphera

• Luxsphera is invite-only, and you need to be 18 or older to make your own account. Anyone under 18 uses a kid's account, which only a parent or guardian can create and look after. Parents and guardians agree to these terms for their children and are responsible for how their children's accounts are used.
• Use your real name, or the name your family knows you by, and keep your password to yourself. You're responsible for what happens on your account.
• Luxsphera is new and still being built. Features may change, and things may occasionally break.

2. Family space rules

Luxsphera is a family space. No sexual content, ever. Accounts that post it are removed.

You also agree not to post or send:

• anything illegal, or anything that exploits or endangers children. Material that sexually exploits children is reported to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement;
• threats, harassment, bullying or hate aimed at anyone;
• someone else's private information, or photos of them they wouldn't want shared, without their permission;
• content you don't have the right to share, such as other people's copyrighted work;
• spam, scams, or links to adult sites;
• anything that tries to break, overload or get around Luxsphera's security.

3. Your content

• You own what you post: messages, photos, events, notes and comments.
• You give Luxsphera permission to store your content and show it to the people in the sphere or conversation you shared it with. We use it only to run Luxsphera, never for advertising.
• You can delete your own content at any time.
• If you leave a sphere, what you shared there stays for the people still in it, because it was shared with them. You can delete it before you leave.
• When you share a photo, you can turn off saving so others can view it but not download it. People can still take screenshots, so share with care.

4. Spheres and managers

• The person who creates a sphere is its manager. Managers can invite and remove people, change roles, and remove messages, photos, comments and events in their sphere.
• Invites are personal. Please invite only people who want to be invited. Everyone joins through a sphere, and each person can invite up to 20 people who are new to Luxsphera each day.
• Sphere sizes. A sphere holds up to 25 people when none of its managers has a plan, and up to 100 when any of them does. If a sphere is over its size, nobody is removed, but no one new can join until there's room.

5. Keeping Luxsphera safe

• Everyone can report a message, photo or comment. Reports go to the sphere's managers and to Luxsphera's administrator. Only the administrator can see who made a report, and the person who posted it is never told.
• Photos and videos (including Rays and still frames taken from videos) are checked automatically against lists of known child sexual abuse images. A match is hidden at once, kept as required by law, reported to the National Center for Missing & Exploited Children (NCMEC), and the account is paused.
• We may remove content, or suspend or close accounts, that break these terms or put others at risk.

6. Plans and payment

• Plans. Glow (3 people, $29 a year), Shine (6 people, $49 a year) and Radiant (10 people, $69 a year). The person who pays is one of the people, along with anyone they choose to add to their plan: people they share a sphere with, and their kids. Everyone on a plan gets 15 GB of storage and 1-minute Rays.
• Trial and free plan. New adult accounts get everything a plan includes for 3 months. After that, accounts not on a plan are free, with 2 GB of storage and 30-second Rays. If a free account is over 2 GB, we email you and give you 30 days to download or delete things, choose a plan or add storage. After 30 days, the oldest photos and videos are removed until the account is under its limit.
• Renewal. Plans and extra storage are paid yearly and renew automatically each year at the price shown when you bought them, until you cancel. You can cancel any time in Profile, Manage billing; your plan keeps working until the end of the year you paid for.
• Changing plans. Moving to a bigger plan, you can pay the difference in price and keep your renewal date, or start a new year that day with the unused part of your old plan taken off the price. Moving to a smaller plan happens on your renewal date.
• Extra storage (50 GB for $15 a year or 100 GB for $25 a year) belongs to the person who buys it.
• Lumens. You can buy Lumens in packs (50 for $5, 100 for $10 or 275 for $25) and use them for paid apps and games in Luxsphera. Lumens don't expire. They're a license to use in Luxsphera, not money: they have no cash value, can't be cashed out, sold or given to another account, and go away if your account is deleted. Kids don't have their own Lumens; when a kid asks to buy something and their guardian says yes, it's paid with the guardian's Lumens. If a Lumen payment is refunded or disputed, the Lumens from it are taken back, even if they've been used, and buying with Lumens pauses until your balance is back above zero. Apps and games you get with Lumens are yours to use for as long as Luxsphera offers them; if one isn't right for you, email us within 14 days and we'll return the Lumens. If we ever stop offering paid apps, we'll give at least 90 days' notice so you can use your Lumens, or ask us to refund Lumens you bought and haven't used.
• Refunds. You can ask for a full refund within 14 days of buying a plan or extra storage, or of a yearly renewal, and within 14 days of buying a Lumen pack if you haven't used any of its Lumens. See our refund policy.
• Who you buy from. You buy from us (Dallas Ray Jackson, doing business as Luxsphera). Payments are processed by Stripe. Sales tax is added at checkout where it's required. We never see or store your full card number.
• Gift codes. We may give out gift codes for a free plan. A gift plan lasts for the time shown when you use the code, then ends on its own; it never renews and is never charged. Each person can use one gift code. Gift codes have no cash value, can't be sold or exchanged for money, and can be turned off by us before they're used. We'll email you about two weeks before a gift plan ends. When it ends, the people on it go back to free accounts, unless you choose a paid plan before then, in which case they move to your paid plan.
• If prices change, we'll tell you at least 30 days before your next renewal.

7. No guarantees

We work hard to keep Luxsphera running and your content safe, but Luxsphera is provided "as is," without warranties. Please keep your own copies of photos that matter to you. To the extent the law allows, Luxsphera isn't liable for indirect losses or for losing content, and our total liability is limited to what you've paid us in the last 12 months, if anything.

8. Leaving

You can stop using Luxsphera at any time. In the app, under Profile, Your data, you can download a copy of your data and delete your account. Deleting removes your messages, photos, videos, Rays, comments and reactions for everyone, and cancels any plan you pay for. Events and board cards you made stay for the people you shared them with, shown as from "Deleted account." Parents and guardians delete their children's accounts from their child's page.

9. Changes

If these terms change, we'll show the new version in the app and ask you to agree before you continue.
